Resolution 3: In Support of NACM Model Code of Conduct
WHEREAS, the Conference of State Court Administrators recognize the critical need for all court employees to perform their jobs in an efficient, effective, and ethical manner; and
WHEREAS, the public entrusts court employees to carry out their duties consistent with the pubic values of open, fair, and impartial processes; and
WHEREAS, to facilitate appropriate conduct many states have adopted codes of conduct for court employees, as well as codes of conduct for judicial officers; and
WHEREAS, it has been some time since the court community reviewed and compared the codes as adopted by individual states; and
WHEREAS, the National Association for Court Management (NACM) reviewed the existing codes and has developed a revised Model Code of Conduct for Court Professionals; and
WHEREAS, NACM's model code includes four canons – (1) avoiding impropriety or the appearance of impropriety in all activities, (2) performing official duties impartially and diligently, (3) conducting outside activities to minimize the risk of conflict with official position, and (4) refraining from inappropriate political activity.
NOW, THEREFORE, BE IT RESOLVED that the Conference commends NACM for their efforts in updating and modernizing the code of conduct; and
BE IT FURTHER RESOLVED that the members of the Conference of State Court Administrators are encouraged to review NACM's model code and consider it as a guide when revising and adopting their own state codes.
