In Support of Adopting the Format and Numbering System of the 2007 ABA Model Code of Judicial Conduct
Resolution 4: In Support of Adopting the Format and Numbering System of the 2007 ABA Model Code of Judicial Conduct
WHEREAS, after four years of study the American Bar Association at its 2007 midyear meeting adopted a Model Code of Judicial Conduct; and
WHEREAS, on February 7, 2007 the Conference of Chief Justices at its midyear meeting adopted Resolution 3 commending the revisions to its members as a foundation upon which states can build to improve and clarify the standards of conduct for the judiciary; and
WHEREAS, it is now within the discretion of each state to determine whether to adopt the revisions, and numerous states have established committees to assist in this process; and
WHEREAS, the Canons have been reorganized to promote a more logical and functional arrangement of the topics; and
WHEREAS, as the various states determine how they will deal with the substance of the revisions, concerns have been raised that the rearrangement of the Model Code may impact research and citation of those provisions; and
WHEREAS, uniformity of the Model Code numbering system throughout the states will substantially foster the development of a more accessible, user-friendly body of interpretative case law dealing with the Code;
NOW, THEREFORE, BE IT RESOLVED that the Conference of Chief Justices encourages each state to adopt the new format and numbering system proposed by the 2007 ABA Model Code of Judicial Conduct without regard to its action on the substance of the proposed changes
